| An individual using the name James Edward Daniels has attempted to get access to participant’s pension benefits. This person is sending out information to participants using the address 108B Ellery Street, Brooklyn, NY 11206.
To date, there are two known incidents where an individual using the name Daniels has attempted to use a Power of Attorney (POA) to defraud the participant. In one incident, Daniels mailed POA documents to a participant. He indicated that he acts on behalf of PBGC to help participants get their entitled pension benefit. He would charge a fee of 25% of the benefit to which the participant is entitled.
On a separate incident, Daniels called PBGC stating he was acting as POA. However, there were no documents on file indicating his authority to handle personal business for the participant.
PBGC does not use third parties to assist participants in getting their benefits. If a participant contacts you stating James Edward Daniels is their POA, please let them know that he is not affiliated with PBGC and should not have information regarding their pension.
In both incidents, Daniels was unsuccessful in getting pension benefits. However, we recommend you stay alert in case he should make another attempt. It is unknown whether or not he is using other names.
If you receive a call from Daniels, DO NOT inform him that he is suspected of fraud. Handle the phone call as you normally would, get the necessary information such as his full name, telephone number or other information you would normally ask. After the phone call, please contact Special Agent Claressia Jones.
